Terms & Conditions Vehicle Hire:
The vehicle can be used for personal or routine business purposes, to be driven only on roads (including unsurfaced roads) and parking areas on East Falkland. The vehicle must not be driven off-road/cross-country or taken to West Falkland.
The customer agrees to comply with all applicable Falkland Islands laws relating to driving in the Falkland Islands. Seat belts must be worn by the driver and passenger(s).
The hire rate includes Third Party, Fire and Theft Insurance cover only unless otherwise stated.
The vehicle will have a full tank of diesel at the start of the hire period and should be returned in the same condition. If the tank is not full on return the cost of the fuel top up will be passed on to the customer together with an administration fee of £25 unless otherwise agreed by Mercado.
The customer agrees to take all reasonable care in the use of and safe keeping of the vehicle and to return it to Mercado in a clean and satisfactory condition. If the vehicle is not in a clean and satisfactory condition on return then a valeting fee will be charged of £50 unless otherwise agreed by Mercado.
Please pay particular attention and take care when opening the vehicle doors. Strong winds can catch doors as they are being opened, forcing them back on their hinges causing damage. Whenever possible, park the vehicle facing into the wind so the doors will not be forced back on opening. Always keep a very firm grip on the door handle as you open it, from both the outside and the inside – use both hands if it is particularly windy.
All drivers must hold a valid Full Clean Driving License for a minimum of 2 years in their country of origin. All drivers must be over 25 years of age.
No use of the hired vehicle “Off Road” or on West Falkland Islands is permitted, if the vehicle is found to be taken off a designated road or taken to the West Falkland Islands a penalty of £500 will be payable.
The customer must not use, or permit the vehicle to be used for any illegal purpose, racing, pace making, competitions or speed testing, teaching somebody to drive or use the vehicle or permit it to be used under the influence of alcohol or drugs.
Must not overload the vehicle, or permit it to be overloaded with passengers and/or baggage.
No towing other vehicles or trailers is permitted.
Not to be used for carriage of goods or Hire & Reward.
Call outs other than mechanical breakdown or faulty equipment will result in a fee of £350.
Not to work on or repair, or let anyone else work on or repair the vehicle without the permission of Mercado.
Replacement keys for the vehicle will be charged at £600 and include loss of rental whilst the vehicle is out of use.
Any damage to tyres (including punctures) and glass on the vehicle will leave the customer liable for the full replacement cost.
Any cancellations are charged at 15% and refunds made via Credit Card/Debit Card will be made less bank charges.
Smoking is not permitted inside the vehicle, if there are signs of smoking inside the vehicle a £250 penalty will be payable. Driving conditions in the Falklands can be challenging at times, particularly on the unsurfaced sections of road. Drivers are likely to encounter loose gravel, pot holes, snow / ice (in winter), sudden gusts of wind, sheep/animals crossing the road, etc., so please be aware of these hazards. The maximum speed limit in Stanley is 25 miles (40 kms) per hour; outside of Stanley it is 40 miles (64 kms) per hour.
The Vehicle owner reserves the right to seek compensation from the customer for the cost of a similar vehicle or repairs for any damage caused to the vehicle during the hire period – in addition, any incurred Freight, Administration, Loss of Income, Legal or Debt collection fees will be also be sought on top.
If the vehicle is returned damaged and deemed repairable by Mercado or their appointed representative, Mercado will obtain a quote from 2 garages within Stanley. Mercado reserves the right to chose which quote the customer will need to pay.
If the vehicle is not deemed to be repairable by Mercado or their appointed representative, the full value of the hire vehicle will be sought in addition, any incurred Freight, Administration, Loss of Income, Legal or Debt collection fees. The value of the hire vehicle is as stated on the insurance documents as Market Value.
- Where the full amount due (including any charges) is not paid within 7 days of a payment being sought then Mercado reserves the right to charge interest on the amount due of 10% per week calculated on a week or part week basis, interest commences when debt chasing letter 1 is issued or referral to our debt collection agency is made. Further, the administrative cost of chasing payments including the cost of any debt collection fees/legal proceedings shall be charged to the Customer. The administrative cost of the first, second and third chasing letter for non-payment will be £20 each, the fourth chasing letter shall be £40.
- The first debt chasing letter shall be sent on day 17 of the payment being sought. If the debtor is not in the Falkland Islands, immediate referral to our debt collection agency will be made and debtor letters 1, 2, 3 & 4 shall not be issued.
- If payment has not been received after letter 1 has been sent, the second debt chasing letter shall be sent on day 27 of payment being sought.
- If still no payment received after letter 1 and 2 has been sent then the third debt chasing letter shall be sent on day 37 of payment being sought.
- Debt letter 4 will be sent on Day 47 of payment being sought and court proceedings shall being.
- If a third debt chasing letter is sent then any debts outstanding by the customer become immediately due and interest on those will be charged from the date of letter 3.
Terms & Conditions Tours:
We here at Travel Falklands want you to have an enjoyable and safe tour with us. We also recognise that occasionally the weather or other factors can mean that things don’t go quite as planned so to protect you and us we have a few simple terms and conditions that apply to your tour;
- The Falklands is a wild and remote place and some tours go off the beaten track and can involve walking on beaches, wet and uneven ground and up and down slopes and inclines. Please make sure that you:
- Wear suitable footwear and have suitable clothing to keep you dry and warm
- Can manage the terrain (and if in doubt please email or call us to discuss any concerns)
- Have any essential medication that you might need for the duration of the tour
- Please take care of all your belongings that you bring on the tour with you. Whilst we are happy for you to leave things on the bus while we are on the tour we cannot accept any responsibility for any loss or damage that might occur to your items.
- We enjoy taking people on tours and we will treat you with courtesy and respect at all times. We expect you to treat our guides and drivers in the same way. If anyone is abusive or aggressive toward our staff then you may be asked to leave the tour and no refund will be given in those circumstances.
- Our driver or guide may take pictures of the tour which we may use for publicity and marketing purposes. If you do not want us to take pictures where you may be present then please tell us.
- If the tour is cancelled due to bad weather or because the cruise ship cancels it’s visit to the Falklands then you are entitled to a refund*. The refund* will be minus 10% to accommodate for bank and admin charges. If this happens, please contact us to request a refund on [email protected].
- If after you have paid for the tour, you change your mind about coming on the tour then provided you let us know 72 hours before the tour starts then we will refund the cost of the tour (less an admin fee of 10%)
- If we have to cancel the tour we will give you a full refund of what you have paid.
- In the unlikely event of a breakdown or accident whilst on the tour we will use our best endeavours to continue with the tour by alternative means or if that is not possible then we will offer you a full or partial refund depending on the circumstances and whether the tour promised to you has been delivered.
- When you make your booking we will keep the personal data you give us confidential and will only disclose it as required by law or in order to contact you about the tour.
